Classic Case
1. The case of a credit card dispute between a branch of Bank of China Limited and Gu Moumou was discussed by the team. According to the principle of "criminal first, civil later", the case may involve credit card fraud, and criminal charges need to be filed first to prove that the case is not a criminal case before the debt can be recovered through litigation. After determining the direction, Lawyer Liu Bing used his own resources and years of experience to communicate with the Economic Investigation Brigade multiple times. After the brigade issued a certificate of non filing, he immediately assigned a lawyer to be responsible for the lawsuit, prepared litigation materials, and assigned other lawyers to cooperate. He requested the court to order Gu Moumou to immediately repay the relevant debts and the expenses incurred in debt recovery. After the court accepted the case, Judge Mao applied the simplified procedure for sole trial in accordance with the law, and the final court judgment fully supported the bank's lawsuit request.
2. A case of a financial loan contract dispute between a branch of Ningbo Yinzhou Rural Cooperative Bank and a logistics limited company, Mao and Zhou. A logistics company entered into a financial loan contract with a branch of Ningbo Yinzhou Rural Cooperative Bank for the purpose of purchasing a car, and Mao and Zhou provided joint guarantee liability. Afterwards, the logistics company repeatedly failed to repay the overdue amount, and despite multiple reminders from the bank, the debt could not be recovered. Therefore, it was decided to take legal action. After a team discussion, it was decided to first pursue the debt through a lawyer's letter. If the lawyer's letter was unsuccessful, it was decided to pursue the debt through litigation. In order to protect the client's creditor's rights and recover them as soon as possible, the handling lawyer worked overtime to organize the litigation materials, clarify the legal relationship, and promptly brought the case to the people's court after the commission. After the court accepted and filed the case, it chose a date to make a judgment and ultimately supported all of our litigation requests.
